Questions were raised regarding a Defense Mapping Agency employee's claim for reimbursement of real estate sale and purchase expenses incurred pursuant to his transfer to a new duty station. It was determined that the claimant was entitled to reimbursement of his real estate sale and purchase expenses, since he was: (1) serving on active duty in the United States when his overseas assignment expired; (2) entitled to return to his former position when his overseas assignment expired; and (3) unable to exercise his right to return to his former position after completion of his active duty military training.
