A firm protested a National Aeronautics and Space Administration (NASA) solicitation for security and law enforcement services, contending that the solicitation's small disadvantaged business (SDB) set-aside restriction was unconstitutional because it precluded it from competition. GAO held that it would not consider the protest, since there was not a clear judicial precedent and the issues involved were more appropriate for resolution by the courts. Accordingly, the protest was dismissed.
