A firm protested the Army Corps of Engineers' rejection of its bid for remedial action, contending that the Corps improperly determined that its bid was nonresponsive, since the corporations named in the bid and bid bond identified the same legal entity. GAO held that the Corps properly rejected the protester's bid as nonresponsive, since: (1) the bid documents did not establish the bidder's identity with sufficient certainty; (2) there was no publicly available evidence that the two corporations identified the same legal entity; and (3) acceptance of the bid would have constituted an improper substitution of bidders. Accordingly, the protest was denied.
