A firm protested a Navy contract award for mess attendant services, contending that the: (1) solicitation contained numerous defects; and (2) Navy improperly made award to the awardee pending its agency-level protest against the terms of the solicitation. GAO held that the protester: (1) untimely filed its agency-level protest 6 months after bid opening; and (2) should have been aware of the solicitation's defects after it began performance on the interim contract. Accordingly, the protest was dismissed.
