A firm protested an Army contract award for refuse disposal services, contending that the: (1) Army improperly rejected its low bid as nonresponsive; (2) Army's award decision was improperly motivated by racial prejudice; and (3) Army should have found the awardee's bid nonresponsive, since it failed to meet a solicitation requirement. GAO held that the: (1) Army properly rejected the protester's bid as nonresponsive, since its bid price and schedule were ambiguous; (2) protester failed to provide any evidence to support allegations that the award was motivated by racial prejudice; and (3) protester was not sufficiently interested to protest the award, since it would not be in line for award even if its protest were sustained. Accordingly, the protest was denied in part and dismissed in part.
