A firm requested reconsideration of its dismissed protest against the Air Force's rejection of its bid and subsequent contract award. GAO had held that the protester failed to file its comments on the Air Force's report within 10 working days after receipt of the report. In its request for reconsideration, the protester contended that its letter in response to the Air Force's request for summary dismissal, sent almost a month prior to the report's due date, should be considered its comments on the agency report. GAO held that the: (1) Air Force's request for summary dismissal did not address the merits of the protest; (2) protester's letter in response to the dismissal request did not constitute its response to the agency report; and (3) protest was properly dismissed, since the protester failed to timely comment on the Air Force's agency report. Accordingly, the dismissal was affirmed.
