A firm claimed reimbursement of its protest costs for a protest against a Department of Energy (DOE) contractor's award of two contracts. GAO had dismissed the protest as academic, since the contractor terminated the contracts and resolicited the requirements. GAO held that the protester was not entitled to reimbursement of its protest costs, since DOE did not unduly delay taking corrective action in response to the protester's protest. Accordingly, the claim was denied.
