Two firms requested reconsideration of their dismissed protests against the Army Corps of Engineers rejection of their bids as nonresponsive. GAO had held that the Corps properly rejected the bids as nonresponsive, since the protesters submitted copies of the required bid bond rather than the original bond. In their requests for reconsideration, the protesters contended that the submission of a copy of the required bid bond was sufficient to satisfy the requirement. GAO held that the: (1) Corps properly rejected the protesters' bids as nonresponsive, since the facsimile copies of their bid bonds did not satisfy the requirement for a bid guarantee; and (2) protesters failed to show any legal or factual errors that would warrant reversal or modification of the original decision. Accordingly, the protests were denied.
