The Department of Agriculture (USDA) requested an advance decision on whether an employee was entitled to reimbursement for real estate expenses incident to his permanent change of station. GAO held that USDA: (1) may not reimburse the employee for expenses he incurred incident to a cancelled contract to purchase a residence at his new duty station; and (2) may only reimburse expenses incurred in connection with a completed sale or purchase, regardless of whether or not the failure to consummate the transaction was the result of a voluntary action by the employee. Accordingly, the claim was denied.
