A firm protested the Panama Canal Commission's (PCC) rejection of its bid for the supply of electrical devices, contending that PCC: (1) improperly determined that its proposed subcontractor was nonresponsible; and (2) showed bad faith when it failed to inform it of the subcontractor's poor performance record. GAO held that: (1) PCC properly considered the subcontractor's prior performance in determining its responsibility; (2) the settlement of an earlier contract dispute did not preclude PCC from considering the subcontractor's prior nonperformance; and (3) the protester presented no evidence that PCC acted in bad faith. Accordingly, the protest was denied.
