A firm protested a Defense Logistics Agency (DLA) purchase order for mechanical seals, contending that DLA deprived it of a reasonable opportunity to compete by failing to promptly forward its bid for evaluation. GAO held that DLA failed to: (1) allow the protester a reasonable opportunity to qualify its alternate product and compete for award; and (2) promptly notify the protester of its product's deficiencies. Accordingly, the protest was sustained and GAO recommended that DLA: (1) allow the protester to qualify its alternate product prior to award of any future contracts; and (2) reimburse the protester for its protest costs.
