A firm protested a Navy contract award for a mine clearing set, contending that the Navy: (1) failed to conduct meaningful discussions; and (2) did not inform it that its bid was too high for the contract award. GAO held that the: (1) protester timely filed its agency-level protest within 10 working days after it learned of the contract award; (2) protester timely filed its protest within 10 days of initial adverse agency action; and (3) Navy was not required to conduct discussions with the protester, since it did not consider the protester's bid too high for work proposed. Accordingly, the protest was denied.
