A former National Guard member requested reconsideration of his claim for incapacitation pay and allowances. GAO would not consider the claim, since the National Guard determined that the claimant did not incur his disability in the line of duty. In his request for reconsideration, the claimant contended that the settlement was a determination of whether his medical condition was service related. GAO held that the claimant failed to present evidence that would warrant reversal or modification of the original decision. Accordingly, the request for reconsideration was denied.
