[Protest of DLA Evaluation of Bid for Mechanical Seals]

A firm protested the Defense Logistics Agency's (DLA) failure to evaluate its bid and provide first-article testing for mechanical seals, contending that DLA: (1) failed to provide the protester with the opportunity to compete and qualify its alternative product; and (2) failure to use first-article testing procedures restricted competition. GAO held that: (1) the protester failed to show evidence of improper DLA action which restricted competition; (2) it would not consider a protest based upon anticipated agency action; and (3) DLA reasonably required preaward qualification testing, since there were problems associated with first-article testing. Accordingly, the protest was denied in part and dismissed in part.
