A firm protested a Department of Veterans Affairs (VA) contract award for building construction, contending that VA: (1) intended to make the award by deviating from the solicitation's award evaluation methodology; and (2) improperly manipulated the funds available to ensure award to the awardee. GAO held that: (1) the awardee was the low bidder, regardless of whether VA evaluated an alternate item; and (2) there was no evidence that VA manipulated funds to ensure award to the awardee. Accordingly, the protest was dismissed in part and denied in part.
