A firm protested a Navy contract award for runway repairs, contending that the: (1) Navy failed to disqualify the awardee under the Buy American Act; (2) Navy improperly required brand-name products; (3) awardee violated U.S.-flag vessel requirements; and (4) awardee improperly used foreign labor at low wage rates. GAO held that the: (1) solicitation was not subject to Buy American Act requirements; (2) protester untimely protested the brand-name specification; (3) U.S.-flag requirement was outside of its protest function; and (4) protest concerning the awardee's labor practices was not a valid basis for protest. Accordingly, the protest was denied in part and dismissed in part.
