A firm protested a General Services Administration (GSA) lease award, contending GSA failed to conduct meaningful discussions. GAO held that: (1) notification of the flaws in the offer would have allowed the protester time either to revise its proposed construction schedule or withdraw its offer; (2) GSA should have amended the solicitation and requested best and final offers; (3) the protester's proposed approach would have required between 15 and 18 months beyond the required time frame; and (4) while the protester was not the low bidder, GSA prejudiced it by failing to conduct discussions. Accordingly, the protest was sustained, and GAO recommended that GSA reimburse the protester for its bid and protest preparation costs.
