A firm protested a Navy contract award for equipment maintenance, contending that: (1) two of the awardee's proposed personnel lacked qualifications required by the solicitation; and (2) the awardee did not possess certain necessary equipment to perform the contract. GAO held that the: (1) Navy reasonably determined that the awardee's proposed personnel satisfied the solicitation's technical qualifications; and (2) requirement to provide certain equipment concerned the contractor's performance obligation and it would not review an affirmative responsibility determination, unless the protester provided evidence of fraud or bad faith. Accordingly, the protest was denied in part and dismissed in part.
