A firm requested reconsideration of the corrective action GAO recommended pursuant to its sustained protest of the National Park Service's (NPS) rejection of its bid. GAO had held that NPS: (1) improperly determined that the protester's bid was nonresponsive; and (2) should reimburse the protester for its bid and protest preparation costs. In its request for reconsideration, the protester contended that it was entitled to reimbursement for its lost anticipated profits, since NPS did not suspend contract performance after it filed its protest. GAO held that: (1) the protester untimely filed its protest for the purposes of achieving contract suspension; and (2) there was no legal basis for allowing recovery of lost profits. Accordingly, the originally recommended corrective action was affirmed.
