A firm protested the Agricultural Research Service's (ARS) rejection of its bid as nonresponsive for a soybean plot combine, contending that: (1) its belt-driven cylinder was acceptable for soybean research purposes and was as convenient to operate as a hydrostatically driven cylinder; and (2) the specification requiring a hydrostatically driven threshing cylinder was unduly restrictive, since the awardee was the only manufacturer of such a cylinder. GAO held that: (1) ARS properly rejected the protester's bid as nonresponsive, since it failed to conform to the solicitation specifications; and (2) the protester untimely filed after bid opening its protest regarding alleged solicitation improprieties. Accordingly, the protest was dismissed.
