A firm protested a Naval Facilities Engineering Command (NAVFAC) contract modification for custodial services, contending that the Small Business Administration (SBA) improperly allowed a modified contract, previously performed under a non-8(a) small business set-aside, into the SBA 8(a) Program. GAO held that NAVFAC failed to provide SBA with sufficient information regarding the proposed modification to determine whether the contract was appropriate for acceptance into the 8(a) Program. Accordingly, the protest was sustained, and GAO recommended that NAVFAC: (1) resubmit the proposed contract modification to SBA with the requirement's complete history; and (2) reimburse the protester for its protest costs.
