A firm protested a Department of Veterans Affairs (VA) contract award for scanner maintenance, contending that the awardee violated: (1) Federal Acquisition Regulation provisions concerning payment of gratuities to government officials and protection of government property; and (2) unspecified conflict-of-interest regulations by providing VA with restrictive bid specifications. GAO held that: (1) it would not review an affirmative responsibility determination unless the protester could provide evidence of fraud or bad faith; and (2) the protester failed to state sufficient legal protest grounds regarding the awardee's alleged conflict of interest. Accordingly, the protest was dismissed.
