A firm protested the Army's termination of its contract and subsequent resolicitation for logistics support, contending that: (1) the Army unreasonably determined that prior discussions were inadequate; (2) the Army properly evaluated bids; and (3) resoliciting the requirements after the disclosure of its bid would result in an unfair auction. GAO held that the: (1) Army reasonably determined that it did not conduct meaningful discussions and evaluate bids in accordance with the specified evaluation scheme; and (2) reopening of negotiations after the disclosure of the protester's bid did not constitute an improper auction, since the reopening was necessary to remedy the improper award. Accordingly, the protest was denied.
