A firm protested a Navy contract award for engineering and technical services, contending that the Navy: (1) improperly disclosed its telecommunicated discussions letter regarding the protester's bid's deficiencies to the awardee; and (2) failed to include appropriate minimum wage and fringe benefit provisions in the solicitation. GAO held that the protester untimely filed: (1) its protest regarding disclosure of the discussion letter more than 10 days after it became aware of the basis for protest; and (2) after bid opening its protest regarding alleged solicitation defects. Accordingly, the protest was dismissed.
