A firm protested the Naval Facilities Engineering Command's (NAVFAC) rejection of its bid, contending that: (1) NAVFAC improperly rejected its low bid as nonresponsive; and (2) it cured any defect in its bid guarantee by executing the performance and payment bonds after bid opening. GAO held that: (1) NAVFAC properly rejected the protester's bid as nonresponsive, since the protester's uncertified check did not represent a firm commitment, as the solicitation required; and (2) inadequate bid guarantees could not be corrected after bid opening. Accordingly, the protest was dismissed.
