A firm protested an Army and Air Force National Guard Bureau (NGB) cancellation of a solicitation for integrated thermal signature targets, contending that NGB: (1) improperly rejected its product sample based on an incorrect interpretation of the specification; (2) would have found its product acceptable if it had tested its sample for the thermal image requirement; and (3) improperly cancelled the solicitation to subvert and circumvent the bid protest process. GAO held that the protester: (1) untimely filed after bid opening its protest regarding alleged solicitation defects; (2) would not be in line for the award even if its protest were sustained; and (3) failed to show that NGB acted in bad faith to specifically and maliciously injure the protester. Accordingly, the protest was dismissed.
