A firm protested an Environmental Protection Agency (EPA) contract award for a spectrometer, contending that EPA: (1) improperly rejected its bid; (2) did not provide the protester with an opportunity to submit its best and final offer under the resolicitation; and (3) improperly determined that the awardee's product complied with the specifications. GAO held that: (1) the protester untimely filed after bid opening its protest regarding alleged solicitation improprieties; (2) EPA provided adequate notice of its request for best and final offers; and (3) EPA, after verifying the awardee's assertions and descriptive literature, reasonably concluded that its product complied with the specifications. Accordingly, the protest was denied.
