A firm protested an Air Force contract award for refuse collection, contending that the: (1) awardee criminally misrepresented itself in its original bid certifications, which the Air Force improperly allowed it to correct; and (2) Air Force acted in bad faith by continuing to find the awardee responsible despite knowledge of its alleged offenses. GAO held that there was no evidence that the: (1) Air Force acted in bad faith in finding the awardee responsible; and (2) awardee deliberately misrepresented its certifications. Accordingly, the protest was denied in part and dismissed in part.
