[Protest of Army Solicitation for Gas Mask Canisters]

A firm protested an Army solicitation for gas mask containers, contending that the Army was required to procure the canisters using sealed bidding procedures. GAO held that the: (1) Army's failure to utilize sealed bid procedures prejudiced the protester; (2) likelihood of unexpected changes occurring after bid opening and before award did not adequately justify the conduct of discussions; and (3) Army was required to employ sealed bidding procedures. Accordingly, the protest was sustained, and GAO recommended that the Army: (1) recompete the procurement using sealed bid procedures; and (2) reimburse the protester for its protest costs.
