[Protest of BOP Rejection of Bid for Alarm Installation]

A firm protested the Bureau of Prisons' (BOP) rejection of its bid as nonresponsive for alarm installation, contending that BOP erroneously advised that it was not necessary to acknowledge a solicitation amendment. GAO held that: (1) the amendment, which extended the contract performance period, imposed no additional obligation on the contractor and was not material; and (2) BOP should have waived the firm's failure to acknowledge it as a minor informality. Accordingly, the protest was sustained, and GAO recommended that BOP: (1) award the contract to the protester, if otherwise appropriate; and (2) reimburse the protester for its protest costs.
