A firm protested a Federal Prison Industries (FPI) contract award for key locks, contending that it was the low bidder. GAO held that FPI unreasonably determined the that the protester was nonresponsible without referring its determination to the Small Business Administration (SBA) under certificate-of-competency procedures. Accordingly, the protest was sustained, and GAO recommended that FPI: (1) refer its nonresponsibility determination to SBA; (2) terminate the awarded contract, if appropriate; and (3) reimburse the protester for its protest costs.
