A firm protested an Army contract award for refuse collection, contending that the: (1) Army improperly rejected its low bid, since the Army failed to furnish it with the requisite forms; (2) awardee was not able to provide the required equipment under the contract; and (3) Army was biased against its owner's brother. GAO held that: (1) the protester untimely filed its protest more than 10 days after it knew the basis for protest; (2) it would not review the Army's affirmative responsibility determination; and (3) the protester failed to show any fraud or bad faith on the Army's part. Accordingly, the protest was dismissed.
