A firm requested reconsideration of its dismissed protest against allegedly restrictive Army solicitation specifications. GAO had held that the protester untimely filed its protest more than 10 working days after initial adverse agency action on its agency-level protest. In its request for reconsideration, the protester contended that the Army considered its protest after bid opening. GAO held that the Army's receipt of proposals on the scheduled closing date without taking corrective action in response to the protester's agency-level protest constituted initial adverse agency action. Accordingly, the dismissal was affirmed.
