A firm protested the National Institute on Drug Abuse's (NIDA) rejection of its late bid for computer services, contending that: (1) government mishandling caused the late receipt of its bid; (2) the solicitation included an inappropriate late-bid clause; and (3) even if untimely, its protest warranted consideration on the merits. GAO held that the: (1) U.S. Postal Service's untimely delivery of the protester's bid did not constitute government mishandling; (2) protester untimely filed after bid opening its protest concerning solicitation defects; and (3) protest did not present an issue of sufficient concern to warrant consideration as an exception to the timeliness requirements. Accordingly, the protest was denied in part and dismissed in part.
