A firm protested the Defense Logistics Agency's (DLA) rejection of its bid and subsequent contract award for snow parkas, contending that: (1) a Small Business Administration (SBA) regulation allowed it to subcontract for 100 percent of the manufacturing operations; and (2) the awardee did not intend to comply with the solicitation's 50-percent maximum subcontracting requirement. GAO held that the: (1) protester's bid took exception to the solicitation's 50-percent maximum subcontracting requirement; (2) protester untimely raised after bid opening the issue of discrepancies between the solicitation requirements and the SBA regulation; and (3) awardee did not take exception to the 50-percent maximum subcontracting requirement. Accordingly, the protest was denied.
