A Department of Agriculture (USDA) employee appealed the denial of his claim for temporary quarters subsistence expenses incident to a transfer from overseas. GAO held that the claimant was: (1) not eligible for relocation expenses; and (2) eligible for a home service transfer allowance, since he was transferred overseas under the authority of the Foreign Service Act and agreed to remain in government service for 12 months upon his return. Accordingly, USDA should allow the claimant a home service transfer allowance.
