A firm protested the National Institutes of Health's (NIH) rejection of its bid for asbestos abatement as nonresponsive, contending that the photocopied signatures on its bid bond could be waived as a minor informality, since the sureties had agreed to the liability. GAO held that NIH properly rejected the protester's bid as nonresponsive, since the bid bond was: (1) of questionable enforceability; and (2) a material condition of the bid and not correctable after bid opening. Accordingly, the protest was denied.
