The Marine Corps requested a decision concerning a civilian employee's claim for reimbursement for a living quarters allowance. The Marine Corps denied the claim because authorizing regulations limited reimbursement of rent subsidies to 10 years, and the employee received the subsidy while he lived in the house. GAO held that the employee was entitled to reimbursement for the rental portion of the leased quarters he occupied, since: (1) authorizing regulations did not bar reimbursement of rent subsidies for lease of rental quarters; (2) the employee sold his house, and did not occupy it after the sale; and (3) the employee paid rent on the leased quarters, and was not the owner. Accordingly, the claim was allowed.
