A firm protested a Bureau of Indian Affairs (BIA) contract award for the administration of its Special Higher Education Program, contending that BIA: (1) improperly failed to consider the qualifications of one of its key personnel; (2) improperly evaluated proposals based on unstated evaluation criteria; (3) should have awarded it the contract as the low offerer; (4) should have allowed it to correct a technical deficiency as a bid error; and (5) failed to provide adequate time for submission of best and final offers. GAO held that: (1) BIA reasonably evaluated the protester's key personnel; (2) BIA evaluated initial proposals consistently with the stated evaluation criteria; (3) BIA properly awarded the contract to a higher bidder; (4) the technical deficiency did not consitute a bid error; and (5) the protester untimely protested the allegedly insufficient time for submission of best and final offers. Accordingly, the protest was denied.
