A firm protested the Army Corps of Engineers' rejection of its telecopied bid modification and subsequent contract award to another firm for water and sewer facilities construction, contending that the Army should have waived its failure to sign the modification as a minor informality. GAO held that the Army properly rejected the protester's bid as nonresponsive, since: (1) no other signed document accompanied the modification; and (2) there was no other evidence of the protester's intent to be bound by the submitted modification. Accordingly, the protest was denied.
