A firm protested a Department of Agriculture (USDA) contract award for janitorial services, contending that: (1) USDA improperly failed to consider its prompt-payment discount in evaluating its bid; and (2) the awardee was not a small disadvantaged business. GAO held that: (1) USDA properly did not consider the discount in accordance with federal procurement regulations; and (2) the procurement was a small business set-aside, instead of a small-disadvantaged-business set-aside. Accordingly, the protest was denied in part and dismissed in part.
