A National Security Agency (NSA) employee claimed backpay retroactive to the time he was hired, contending that an NSA administrative error deprived him of his legal right to appointment at the highest grade, since NSA hired him at a certain grade, then promoted him to a higher grade after reassessing his qualifications. GAO held that there was no administrative error at the time of his appointment, since NSA reasonably exercised its discretion in appointing him at a lower grade. Accordingly, the claim was denied.
