A firm protested a Navy solicitation for a remote strafe scoring system, contending that the: (1) solicitation improperly disclosed its proprietary data; and (2) disclosure improperly benefited its competitor under the procurement. GAO held that the protester untimely filed its protest against the Navy's disclosure of its proprietary data more than 10 days after it knew the basis for protest. Accordingly, the protest was dismissed, and GAO recommended that the protester take appropriate action against the government for damages or settlement of its claim that the Navy infringed upon its proprietary rights.
