[Protest of Navy Rejection of Bid as Late]

A firm protested the Navy's rejection of its bid as late, contending that: (1) it would have timely delivered a copy of its bid by hand, if it had been able to ascertain that the Navy had not received it; (2) the Navy improperly failed to extend bid opening after amending the solicitation; and (3) acceptance of its bid would not prejudice other offerers. GAO held that the Navy properly rejected the protester's bid, since: (1) mail delivery problems, not government impropriety, caused the bid's lateness; (2) the protester untimely filed its protest regarding solicitation improprieties; and (3) applicable regulations prohibited acceptance of late bids. Accordingly the protest was dismissed.
