A firm protested any Army contract award to another firm for heat recovery systems, contending that: (1) all lower bids did not comply with the solicitation specifications; and (2) the Army should award it the contract. GAO held that the: (1) mere alleged noncompliance with the solicitation specifications did not render the bids nonresponsive; and (2) protester failed to show that the Army's determination was fraudulent or in bad faith. Accordingly, the protest was dismissed.
