A firm protested a Defense Logistics Agency (DLA) contract award to another firm for drilling machines, contending that the awardee failed to: (1) acknowledge a material solicitation amendment; and (2) submit prices for certain line items. GAO held that: (1) since DLA waived first-article testing for the awardee, its failure to acknowledge the amendment did not render its bid nonresponsive; and (2) the Army properly waived the awardee's failure to submit bid prices for the line items, since it agreed to furnish the equipment at no extra charge. Accordingly, the protest was denied.
