[Request for Reconsideration of Sustained Protest Against Army Corps of Engineers Rejection of Bid]
B-228449.2: Feb 29, 1988
- Full Report:
The Army Corps of Engineers requested reconsideration of a sustained protest against its rejection of a bid under a solicitation for dredge drydock and repair. GAO had recommended that the Army award the contract to the protester, if appropriate. The Army contended that: (1) it awarded the contract to the second low bidder because of urgent and compelling circumstances which prohibited waiting for the GAO decision; and (2) the awardee had almost completed the contract. Accordingly, the original recommendation was withdrawn, and GAO recommended that the Army reimburse the protester for its bid and protest preparation costs.
