A firm protested a Department of Energy (DOE) solicitation for technical manuals and duplicating services, contending that: (1) the security clearance requirement unduly restricted competition, since DOE would not initiate security clearance action unless a bidder received notice of contract award and the clearance time was too long for a bidder that was not already cleared; and (2) a provision that allowed DOE to control voucher approvals would delay payments, establish conditions for fraud, and prohibit the contractor's right to appeal. GAO held that: (1) DOE properly required the security clearance, since the information contained in the publications was classified; and (2) since the protester could not compete because of the security problems, it was not sufficiently interested to protest the solicitation provisions. Accordingly, the protest was denied in part and dismissed in part.
