[Protest of HUD Rejection of Bid for Refrigerators]

A firm protested the Department of Housing and Urban Development's (HUD) rejection of its bid for refrigerators as nonresponsive, contending that HUD arbitrarily and unfairly refused to: (1) waive certain requirements, as it had done under prior contracts; and (2) consider its offer to modify its proposal after bid opening. GAO held that the: (1) protester's bid was nonresponsive, since it took exception to the solicitation's warranty provisions; and (2) protester could not cure its nonresponsive bid after bid opening. Accordingly, the protest was denied.
