A firm protested the Army's rejection of its low bid for storage equipment as nonresponsive, contending that its product complied with the solicitation's brand-name-or-equal requirements. GAO held that the Army improperly rejected the protester's bid, since the: (1) product met all specified requirements; (2) protester furnished sufficient descriptive literature for proper product assessment; and (3) Army based its rejection on the product's failure to equal unspecified features of the brand-name product. Accordingly, the protest was sustained, and GAO recommended that the Army: (1) terminate the awarded contract and award it to the protester, if appropriate; or (2) reimburse the protester for its bid and protest preparation costs.
